Terms of Service
By renting products and/or services from Bloomiful Design, Client agrees to the following Terms and Conditions:

PAYMENTS
We offer multiple payment options. Payment may be made in full or split into installments. Payments are processed through a third-party platform (Stripe), which offers split payment options through Klarna, Zelle, Apple Pay, and Venmo. We may offer a four (4) month payment plan upon approval.
A non-refundable retainer of at least twenty-five percent (25%) of the total balance is required to reserve the event date. The retainer will be applied toward the total cost of the wedding/event.

DISCLAIMER
By renting Bloomiful Design’s floral arrangements, Client understands that while some flowers closely resemble real flowers and may be named after real varieties, the majority of arrangements are artificial and are designed to replicate the appearance of real florals.

BALANCE DUE
The remaining balance must be paid in full no later than thirty (30) days prior to the wedding/event date. If the balance is not paid by this deadline, flowers and décor will not be ordered and this contract may be closed at the discretion of Bloomiful Design.
If Bloomiful Design determines the contract can still be fulfilled after this deadline and Client wishes to proceed, a ten percent (10%) late fee will be added to the outstanding balance, with an additional ten percent (10%) fee applied every seven (7) days thereafter. Any extraordinary costs incurred as a result of late payment will be passed on to the Client.

ADDITIONS & CHANGES
Additions requested less than thirty (30) days prior to the event will be accepted up to seven (7) days prior to the event date and must be paid within twenty-four (24) hours. Availability of identical florals is not guaranteed; Bloomiful Design will match color and style as closely as possible based on availability.
At the time of the initial retainer, invoice adjustments may be made. Large additions or subtractions are permitted until the balance is paid in full. A guaranteed minimum of eighty-five percent (85%) of the original proposal applies.

SUBSTITUTIONS
Bloomiful Design reserves the right to make substitutions if flowers or décor received are not suitable for the wedding/event. The integrity of the proposed design, color palette, and overall aesthetic will be maintained using items of equivalent value.
Client acknowledges that dyed flowers may be used and Bloomiful Design shall not be held liable for staining to garments or surfaces caused by such items.
PRICING & LIABILITY
Any liability on the part of Bloomiful Design is limited to a refund of monies paid, excluding the retainer. Due to fluctuating flower prices, pricing increases may occur for rentals including fresh florals. Client will be notified as soon as Bloomiful Design is made aware of such increases, and payment will be due within thirty (30) days of notification.

SETUP LOCATIONS & MOVES
Pricing includes one (1) setup location only. Additional fees apply if rental items are moved between locations (e.g., ceremony to reception). Bloomiful Design requires its own team to move all items unless prior written approval is granted, due to insurance restrictions.
Client is responsible for confirming with the venue that rentals will fit in the desired space.

DELIVERY, SETUP & PICKUP
All orders include delivery, setup, and pickup within thirty (30) miles of Bloomiful Design’s warehouse, with pickup no later than 9:00 PM. Deliveries beyond 30 miles will incur additional fees, typically calculated at $1 per mile, subject to location and setup requirements.

LATE NIGHT PICKUP FEES
Pickups after 9:00 PM are subject to the following fees:
• 9:30 PM – $50
• 10:00 PM – $100
• 10:30 PM – $150
• 11:00 PM – $200
• 11:30 PM – $250

PARKING & VENUE ACCESS
Client agrees to provide adequate vendor parking and reasonable access for Bloomiful Design’s vehicles and team at all event venue location(s) for delivery, setup, breakdown, and pickup. Any parking fees, valet fees, garage fees, loading fees, permits, or access charges required by the venue, municipality, or property management—including paid or restricted parking—are the responsibility of the Client unless otherwise stated in writing.
Client agrees to communicate all venue access instructions, parking details, and load-in/load-out restrictions no later than fourteen (14) days prior to the wedding/event date. Bloomiful Design shall not be held responsible for delays, inability to perform services, or additional fees incurred due to restricted access or parking conditions not disclosed in advance.
Any parking or access fees incurred by Bloomiful Design will be billed to the Client or charged at actual cost.

PRODUCT HANDLING & DAMAGE
No rentals may be left outside overnight. Arches, backdrops, and floral arrangements may not be exposed to rain. If inclement weather occurs, Bloomiful Design reserves the right to remove items early to prevent damage.
No one may transport, move, or dismantle Bloomiful Design products without prior written approval. Damage beyond normal wear will be charged at three (3) times the rental price. Items not returned within the rental period will be charged at four (4) times the rental price and become the property of the Client.

VENUE LIMITATIONS
Bloomiful Design is subject to venue rules and regulations. Negotiation with venue management is the responsibility of the Client. No refunds will be issued for unused items due to undisclosed venue
CANCELLATIONS
A ninety (90) day cancellation notice is required. Retainers are non-refundable. In the event of emergencies or force majeure events, retainers may be transferred to a new date at Bloomiful Design’s discretion.

RIGHT TO CANCEL
Bloomiful Design reserves the right to cancel this contract if obligations cannot be met. Client will be refunded amounts paid minus actual costs incurred.

FORCE MAJEURE
Bloomiful Design shall not be liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, fire, flood, war, pandemic, government regulation, labor disputes, venue shutdowns, or transportation interruptions. In such events, Bloomiful Design may reschedule services or apply payments toward a future date. Refunds shall be limited to amounts paid minus the retainer and any costs incurred.

INSURANCE
Bloomiful Design maintains general business liability insurance. However, Bloomiful Design shall not be responsible for consequential damages, personal injury, or property damage beyond the limits expressly stated in this agreement.

INDEMNIFICATION
Client agrees to indemnify and hold harmless Bloomiful Design, its owners, employees, and contractors from any claims, damages, losses, or expenses arising out of the event, including but not limited to venue damage, guest injury, or misuse of rented items, except in cases of gross negligence by Bloomiful Design.

LIMITATION OF LIABILITY
Bloomiful Design’s total liability under this agreement shall not exceed the total amount paid by Client.

ATTORNEY’S FEES
In the event of any legal action arising from this agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.
DISPUTE RESOLUTION
Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association.
